1) Who we are

These Terms of Service/Use ("Terms") apply to Mom Index (the "Platform," "we," "us," "our"), including:

• momindex.ca and canadianmom.co (the "Sites"), and
• our related community channels we operate or moderate (including reddit.com/r/mompics) (collectively, "Community Spaces").

Important: Reddit is a third-party platform. Use of Reddit is also governed by Reddit's own terms and rules. If there is a conflict between Reddit's terms and these Terms, Reddit's terms control for your use of Reddit.

2) Acceptance of these Terms

By accessing or using the Platform, you confirm that you:

• have read and agree to these Terms, and
• will follow all applicable laws and regulations.

If you do not agree, do not use the Platform.

3) Age restrictions (mandatory)

The Platform contains content related to cannabis deals, listings, and reviews. You must meet the minimum age below to access or use the Platform.

• Canada (Platform rule): You must be 19+ to browse or use the Platform (even if your province allows 18+).
• Québec: You must be 21+ (Québec restricts cannabis possession/access under 21).
• United States: You must be 21+ (and you are responsible for complying with your state/local laws). Although we are a Canadian-only community and do not advertise to the United States.

By using the Platform, you represent and warrant that you meet the applicable age requirement. We may use age gates and may suspend/ban users we reasonably believe are underage.

4) What we do (and what we do NOT do)

We are not a cannabis seller. The Platform is a listing, browsing, deals, and review community.

• We do not produce, distribute, ship, sell, or fulfill cannabis or cannabis accessories.
• We do not process payments for cannabis.
• We do not provide customer service for any purchase you make from a third party.
• Any transaction is strictly between you and the third-party retailer/service.

5) Third-party listings, links, and services

The Platform may display or link to third-party websites, vendors, or services ("Third Parties"), including listings and deal information.

• Third-Party content is provided for convenience and informational/community discussion purposes only.
• We do not control Third Parties and are not responsible for their products, pricing, availability, legality, shipping, returns, or customer support.
• Your dealings with any Third Party are at your own risk.

6) Cannabis promotion compliance (Canada)

Canada's Cannabis Act generally prohibits "promotion" of cannabis, cannabis accessories, and services related to cannabis, except in limited circumstances, and includes restrictions such as prohibitions on content that could appeal to young persons, testimonials/endorsements, depiction of persons/characters/animals, lifestyle association (glamour, recreation, excitement, vitality, risk/daring), and false/misleading representations.

Because of these rules, you agree that you will not post, upload, or share content on the Platform that would cause us (or you) to breach applicable promotion restrictions. Without limiting the above, you agree you will not post content that:

• is appealing to minors/young persons,
• uses testimonials/endorsements or celebrity-style promotion,
• depicts real or fictional people/characters/animals to promote cannabis,
• promotes a "lifestyle" association (glamour, excitement, recreation, risk/daring), or
• is false, misleading, deceptive, or makes unsupported claims about effects/health risks.

No inducements: You must not post content that promotes prohibited giveaways/bonuses/inducements in a way that violates applicable law.

Adult access: You must not share Platform content with minors or use the Platform in a way intended to reach minors. The Cannabis Act includes specific concepts around restricting youth access to promotions.

7) Listings and advertisers (extra requirements)

If you submit a listing, deal, or advertisement (including via a paid placement, sponsorship, affiliate arrangement, or any "featured" placement):

• You represent that you (and/or the business you represent) are properly authorized/licensed to conduct the activities you advertise, including under federal and applicable provincial/territorial law.
• You are solely responsible for ensuring your content complies with all cannabis promotion restrictions and any platform policies, including age-gating requirements.
• You agree we may request verification (at our discretion) and may remove or refuse content for any reason.

8) Community reviews and "deal" posts (user-generated content)

Users may post reviews, commentary, opinions, and deal observations ("User Content"). You understand:

• User Content reflects the author's views, not ours.
• We do not guarantee accuracy, completeness, or legality of any User Content.
• We may remove User Content at any time.

No medical advice: Content on the Platform is not medical advice. Do not rely on it for health decisions.

9) Prohibited conduct

You agree you will not:

• use the Platform for any unlawful purpose;
• facilitate illegal sales, trafficking, or distribution;
• post sources you know (or reasonably should know) are illegal/unlicensed;
• post personal data (doxxing), harassment, hate, threats, or defamatory content;
• impersonate others or misrepresent affiliations;
• attempt to bypass age gates, security, or scrape/harvest data;
• upload malware or interfere with Platform operations;
• post spam, deceptive marketing, or undisclosed paid endorsements.

10) Content ownership and license

You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, distribute, modify (for formatting/moderation), and create derivative works from your User Content for operating and promoting the Platform (including in Community Spaces), unless prohibited by law.

You represent you have all rights needed to post your User Content.

11) Moderation and enforcement

We may (but do not have to) monitor, edit, remove, or restrict content; suspend accounts; or ban users—without notice—if we believe there is a risk of legal non-compliance, harm, or Terms violations.

12) Intellectual property

The Platform (design, logos, databases, text, features) is owned by us or our licensors and is protected by applicable IP laws. You may not copy, reproduce, sell, or exploit Platform content except as expressly permitted.

13) Disclaimers (important)

To the fullest extent permitted by law:

• The Platform is provided "as is" and "as available."
• We disclaim all warranties (express, implied, or statutory) including merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant uninterrupted or error-free operation, or that content is accurate, compliant, or up to date.

14) Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to:

• your use of (or inability to use) the Platform,
• Third-Party products/services or transactions,
• User Content, listings, deals, pricing, availability, or legality, or
• any moderation decisions.

If a court finds we are liable despite the above, our total liability will be limited to the greater of CAD $100 or the amount you paid us (if any) in the 3 months before the event giving rise to the claim.

15) Indemnity

You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• your use of the Platform,
• your User Content or listings,
• your violation of these Terms or applicable law, or
• your dealings with any Third Party.

16) Privacy

Our collection and use of personal information is described in our Privacy Policy (to be posted separately).

17) Changes to the Platform or Terms

We may change the Platform or these Terms at any time. Updated Terms apply when posted (or as otherwise stated). Your continued use means you accept the updated Terms.

18) Termination

We may suspend or terminate your access at any time for any reason (including compliance risk). Sections intended to survive termination (including disclaimers, limitation of liability, indemnity, and governing law) will survive.

19) Governing law and venue (Ontario)

These Terms are governed by the laws of Ontario and Canada applicable therein, excluding conflict-of-law rules. You agree that disputes will be brought in the courts located in Ontario, unless prohibited by law.

20) Severability

If any provision is found unenforceable, the rest remains in effect.

21) Entire agreement

These Terms, plus any posted policies (e.g., Privacy Policy, Community Rules), are the entire agreement between you and us regarding the Platform.
